This article is a good resource for those who want to know more about the most raised question – How can the intellectual property community protect their intellectual property without the DMCA safeguards? Read along ..
In my opinion, DMCA safeguards are a necessity for the IP community to keep up in business, although we may think of a potential advantage from advertising. If somebody's mere existence depends on the royalty from the true original work, he would run out of business if his IPR is infringed upon. Big companies can try not using DMCA measures to increase initial sales and goodwill. But thats not a viable solution. I wonder if any acceptable business model is developed that can work well without using DMCA safeguards?
My understanding is that DRM technology is not a must to be added onto a digital file. Its the will of the copyright holder to impose it so that they don't run out of business by unauthorized reproduction and tampering. Now, the copyright holders should decide whether they should continue using the DMCA safeguards or just let the sales rise by allowing DRM free, high quality digital content.
